Over the course of 2020 and 2021 the U.S. Congress, U.S. Supreme Court, and the NCAA worked on legislation, rulings, and policies to finally agreed that it was time for every intercollegiate student athlete to be granted the right and opportunity to earn income from the use of their name, image, and likeness for sales and marketing endeavors. Since then a whole new world of opportunity has opened up for both student athletes and companies/brands to come together and create relationships that would generate something powerful and meaningful for everyone involved...including fans of college sports. 

For more than a century athletes have been used by brands as powerful influencers through their affiliate relationships and partnerships to generate and increase awareness and sales....even before the term "athlete influencer" was a thing. It's been used for decades because everyone knows it works. Until NIL, only professional athletes benefitted financially from the power of their influence...their "star power". Until NIL, collegiate student athletes' names, images, and likenesses had been used to generate interest and revenue for their respective university's athletic department without receiving direct financial benefit from that use. Now that has all changed.

 

And even though NIL has recently been called "the wild west" because this world is all so new and nobody knows exactly where it's going, it has already had a huge impact on college sports...good and, some would argue, not so good. But even though all parties are still working through trying to figure out what it all means and how it will evolve...one thing is for certain: there is no going back. NIL is here to stay.

The policy provides the following guidance to college athletes, recruits, their families and member schools:

  • Individuals can engage in NIL activities that are consistent with the law of the state where the school is located. Colleges and universities may be a resource for state law questions.

  • College athletes who attend a school in a state without an NIL law can engage in this type of activity without violating NCAA rules related to name, image and likeness.

  • Individuals can use a professional services provider for NIL activities.

  • Student-athletes should report NIL activities consistent with state law or school and conference requirements to their school.
